What to know before recruiting staff from outside the EU
The conditions Emergency Ordinance 32/2026 sets for employers.
- WorkInRomania registration
- In the cases set by the ordinance, the employer must be registered or authorised on the platform.
- Company eligibility
- Tax status, actual business activity and other legal conditions are checked.
- Company track record
- For the D/AM2 procedure, the general rule is at least one year of relevant activity.
- Sanctions
- Relevant sanctions from the last six months and certain criminal convictions are checked.
- Shortage occupations
- For D/AM2, the role must meet the conditions of the applicable list.
- Authorised agency
- In the standard D/AM2 procedure, the registered employer works with an authorised agency.
- Firm job offer
- It must state the role, salary, working hours, duration, leave and working conditions.
- Workers' rights
- The employer must comply with labour law, pay rules and notification obligations.
These requirements are set out in the official WorkInRomania information. There are exceptions, however, and different procedures depending on the worker's category and the type of visa, and procedures and timelines are adapted to the legal requirements and to the availability of the official platforms.

Frequent questions
Who is the consulting for?
For companies that want to recruit foreign workers and for those that already employ foreign staff in Romania and want to manage them correctly.
What does it include?
We explain the relevant legal changes, analyse your company's situation and set out the documents, responsibilities and stages required for the procedure that applies.
Can my company recruit workers from Asia?
Yes, if it meets the conditions of Emergency Ordinance 32/2026, including registration on WorkInRomania, at least one year of actual activity in a field compatible with the role, and a role on the shortage occupations list. The procedure that applies depends on your company's situation and on the workers' category, which is why we check both with you before recruiting.
Do I have to register on WorkInRomania?
As a rule, yes, because Emergency Ordinance 32/2026 requires employers who hire foreign nationals to be registered or authorised on the platform. Some categories of workers are exempt, and we tell you whether that applies to you and help you prepare the documents.
Which documents are needed?
It depends on the procedure. You usually need the documents showing that the company meets the registration conditions, the firm job offer with the role, salary, hours, duration and working conditions, and the worker's papers for the visa. We set out the exact list for your company once we have reviewed the documents.
Can I recruit directly, or do I have to work with an authorised agency?
In the standard procedure, the registered employer signs a service contract with an authorised placement agency. In that procedure, only employers authorised by ANOFM can recruit without an agency, and only for occupations on the shortage list. We explain which option suits your company.
What are my obligations once the workers arrive?
They include paying the salary into the worker's bank account, an employment contract in Romanian and in a language the worker understands, health and safety training, Romanian language courses, and notifying the agency and the General Inspectorate for Immigration, within 5 working days, of unexcused absences or the end of the contract. We help you keep track of them.
What do you get at the end?
A plan tailored to your company, with the conditions to meet, the documents to prepare and the steps to follow, with clearly assigned responsibilities.
Can I ask for consulting without recruitment?
Yes. The service can be requested on its own or together with recruitment and placement through INDICA7.
What about legal matters?
Where a matter needs specialised legal assistance, we decide together whether a lawyer should be involved.
